Civil society representatives from the International Network for Cultural Diversity and the International Liaison Committee of Coalitions for Culture Diversity will join INCP Ministers and Delegates for a reception hosted by Mr. Gilberto Gil, Minister of Culture of Brazil offering participants an opportunity to meet and discuss common areas of interest GRES Portela is one of the most famous samba schools in Rio de Janeiro.  Founded in 1923 this school has gained national and international attention for the quality of its samba performers and in addition, it has had the honour in leading Rio de Janeiro’s annual Carnival parade twenty-one times.  GRES Portela has also produced some of Brazil’s greatest composers of samba music and is also noted for being one of the more traditional samba schools in Brazil.

Session 1: Access to Culture, Copyright and New Technologies: Evolving Challenges to Cultural Diversity

One of the greatest challenges we face today in the formulation of policies to promote and protect cultural diversity is how to get individuals and groups to experience the difference and diversity of cultures – in other words, to have access to culture. In this respect, the right of access to culture, enshrined in the Universal Declaration of Human Rights and in the constitutions of most countries, is a major issue for discussion, especially with the advent of the new technologies, which will be using digital networks as the avenue for dissemination of culture at least for the foreseeable future. In view of this context and given the linkages between new technologies and copyrights system, it is important to explore the challenges that copyrights may present not only to the dissemination of culture but also the access to culture by individuals and groups

Throughout 2006, Brazil, in consultation with INCP members undertook a study, with the objective to explore the impact of copyrights on new technologies being used for disseminating and facilitating access to culture as well as its effects on the protection and promotion of cultural diversity, which will be presented to Ministers during this session.  It is hoped that this session will provide Ministers of Culture with an opportunity to engage in dialogue and freely exchange views and experiences on an issue of importance given its direct bearing on the development of cultural policy particularly in relation to cultural industries, and cultural goods and services which can or do generate authors’ rights.

Key issues for discussion:

  • Why do people consider copyright a taboo subject?
  • Is Copyright an end in itself?
  • Why is Copyright discussed primarily within the scope of commercial policies?
  • How can Copyright be used to strengthen the cultural industries of developing and less developed countries?
  • Can we prevent Copyright from increasing disparities between rich and poor countries in the face on new information and communication technologies?
  • How can we promote equal access for members of society, via new technologies, to the global myriad of cultural expressions without infringing upon Copyrights?
  • How can we guarantee the protection of intellectual production in the digital field?
  • Is it viable to apply the rules of Copyright, in its traditional form, to the digital field?
  • How can we guarantee the enforcement of Copyright law in the digital field without breaking the balance between costs and benefits and without infringing upon basic guarantee, such as the right to privacy and secrecy of correspondence?

15:00 – 16:00 Session 2 UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions

At the Eighth Annual Meeting of the International Network on Cultural Policy (INCP) in Dakar, Senegal (November 2005), Ministers renewed the mandate of the Working Group on Cultural Diversity and Globalization and agreed that it should, over the coming year: develop and implement a convention ratification strategy that would monitor the progress of ratification of the UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions, provide technical advice to INCP members, and play an active advocacy role at the national, regional and international level; consult with INCP members on the nature of the international cooperation that countries are seeking and undertake pilot projects aimed at demonstrating the practical value of the UNESCO Convention; and continue to work with civil society and encourage their active participation in the promotion of the objectives of the UNESCO Convention.

Key issues for discussion:

  • Has the Working Group fulfilled the mandate assigned by Ministers in Dakar?
  • Is there a role for the Working Group with respect to continuing the promotion of the ratification of the Convention and preparing its implementation?  If so, what should be the focus of the Working Group?
  • Should the Working Group’s mandate be renewed, and if so, should it be expanded to include initiatives related to other emerging cultural policy issues?

13:00  Cultural Excursion – Museu de Arte Contemporânea de Niterói

All participants will meet in the lobby of their respective hotel and be transported to the Museum, location of this year’s cultural excursion

The Museu de Arte Contemporânea de Niterói is a Modern Art Museum designed by the world famous architect Oscar Niemeyer and opened in 1996.  Shaped like a spaceship, the modern lines of the buildings draw attention onto itself.  Inside, the Museum exhibits, among other works, paintings by Daniel Senise and the João Sattamini Collection, with works from scores of important Brazilian artists, mostly from the 1980’s.  Thanks to Niemeyer’s ingeniousness, this Museum is one of the few where visitor’s eyes are drawn away from the exhibits to the windows – the view of Guanabara Bay is spectacular (the Museum is located by the Bay). Also, the panoramic window encircling the ring-shaped building reveals a new view at every step, including a unique view of Sugarloaf Mountain.
